(California Court of Appeal) – Denying a petition for writ of mandate and lifting the stay in a case involving the assignment of borrowers who transferred their causes of action relating to their home loans to a plaintiff where some of the defendants filed a motion seeking the joinder of the borrowers, who the plaintiff said didn’t need to be joined because he was prosecuting on their behalf, but the court found no fiduciary relationship existed, and so the other parties must be joined.
