(United States Second Circuit) – Affirming in part, vacating in part, and remanding the district court denial of maritime liens and the sua sponte entry of summary judgment in favor of a vessel in a suit involving competing maritime lien claims arising from the delivery of fuel to a vehicle. The entry of summary judgment before the plaintiff had the opportunity to present its relevant evidence was in error.
